Yet one has to wonder what the appropriate punishment is for people who are so elderly- particularly in Demjanjuk's case. What's a punishment fitting the crime? And to what extent will victims' and survivors' families feel that the very process of justice is, in itself, enough to provide the kind of catharsis they may need? Lots of tough questions here. There’s no doubt (in my mind, at least) that these men should be held accountable for what they did. There shouldn’t be a statute of limitations on genocidal crimes, whether from a legal perspective or a moral one.

Yet one has to wonder what the appropriate punishment is for people who are so elderly- particularly in Demjanjuk’s case. What’s a punishment fitting the crime? And to what extent will victims’ and survivors’ families feel that the very process of justice is, in itself, enough to provide the kind of catharsis they may need? Lots of tough questions here.

The episodes covered in this article are two of the darkest in human history; it would be hard to press for legal forgiveness in these cases. Of course, once you prosecute, you run into the issue Carlo brought up. I mean, does an appropriate punishment even exist for mass murder / genocide? It would depend on the sin, wouldn’t it? I guess the difficulty is, what will be the result and what is the cost? What good will come out of imprisoning a frail, 90 year old man, and what is the cost? I guess it goes deeper when you think about: what is the purpose of prison/punishment? Is it rehabilitation? Is it purely punitive? Is it to set an example? Is it justice to the victims and their families (and will this justice EVER be enough to them)? I suppose it is parts of all the above. I think it's obvious the current justice system doesn't work.
